Terms and Conditions

These Terms and Conditions govern your use of onesend, an email delivery service operated by WOCOO Management and Consulting GmbH, Austria ("onesend", "we", "us"). By creating an account or using the service, you agree to these Terms.
1. The service
onesend provides transactional email delivery over an HTTP API and SMTP, together with domain authentication, suppression management, and deliverability reporting. We operate the sending infrastructure within the European Union.
2. Accounts
You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your account and for the content of the email you send through it. You must verify your email address before sending, and verify each sending domain before email from that domain is accepted.
3. Free trial
- Every new account starts on a free trial limited to 100 emails in total. The allowance is cumulative, not monthly, and does not reset or renew.
- The trial has no time limit. It ends when the 100-email allowance is used up, or when you subscribe to a paid plan.
- Only emails actually sent count against the allowance. Messages rejected before sending, such as invalid addresses, suppressed recipients, or pre-send validation failures, do not consume the allowance.
- When the allowance is used up, sending stops. Your account and its data are retained, and processing of bounces and complaints for mail already sent continues.
- We may adjust or withdraw the trial for new signups and take reasonable measures against abuse, including against the creation of multiple accounts to obtain repeated free allowances.
4. Plans and pricing
We offer two subscription plans. Prices are shown exclusive of VAT (see section 7).

"Emails" means individual messages accepted for sending, counted per recipient. Pre-send rejections do not count. Current pricing and included volumes are those shown on our pricing page and may change. We will give reasonable notice of changes as required by applicable law.
5. Overage
Sending beyond your plan's monthly included volume incurs overage at the plan's overage rate. Overage is calculated in increments of 100 emails, rounded to the nearest 100. It accrues over the billing month and is billed once, on your following invoice, rather than as separate per-use charges.
6. Usage caps and continuity of service
While your subscription is active, reaching your included volume does not stop sending. Delivery continues and the excess is billed as overage on your next invoice (a soft cap). Your dashboard notifies you as you approach and reach your included volume.
If your subscription is cancelled or lapses, a hard cap applies and sending stops. Processing of bounces and complaints continues. We may designate certain accounts as billing-exempt as an internal arrangement, which is not a customer entitlement.
7. VAT and invoicing
All prices and overage rates are stated exclusive of VAT. VAT is added where applicable and is determined at billing time under EU rules:
- Customers outside the EU are not charged EU VAT.
- EU customers without a valid VAT ID are charged the applicable country VAT rate.
- EU business customers outside Austria with a validated VAT ID are handled under the reverse-charge mechanism, where you account for VAT.
- Austrian customers are charged Austrian VAT regardless of VAT ID.
VAT IDs are validated through the EU VIES system, and reverse charge is applied only on a confirmed-valid VAT ID. We issue invoices for subscription charges and any accrued overage.
8. Payment
Payments are processed by Mollie, an EU payment provider, using card, SEPA, and other supported EU methods. Subscriptions renew automatically each month on your billing anchor date until cancelled. By subscribing you authorise these recurring charges. If a payment fails, we may retry and, if it remains unpaid, suspend sending under the hard cap.
9. Cancellation and refunds
You can cancel at any time. Cancellation stops future renewals, and the hard cap then applies. Data retention follows your account's retention settings and applicable law. Any statutory right of withdrawal for consumers under EU and Austrian distance-selling law is unaffected. Refund arrangements are set out in accordance with applicable law.
10. Acceptable use
You may send only email that the recipient has a lawful basis to receive, and you must comply with applicable anti-spam and data-protection law. You may not use onesend to send unlawful, deceptive, or harmful content, or to send unsolicited bulk email. We may suspend sending that threatens the reputation or integrity of our infrastructure or other customers.
11. Data protection
Our processing of personal data is described in our Privacy Policy. Where we process personal data on your behalf as a processor, that processing is governed by a data processing agreement available on request.
12. Availability and liability
We provide the service with reasonable skill and care but do not warrant uninterrupted or error-free operation. To the extent permitted by law, our liability is limited, and nothing in these Terms excludes liability that cannot lawfully be excluded. Mandatory consumer rights are unaffected.
13. Changes to these Terms
We may update these Terms and will communicate material changes with reasonable notice as required by applicable law. Continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by Austrian law, with mandatory consumer protections of your country of residence unaffected. The place of jurisdiction is determined in accordance with applicable law.
